Estate Planning: Working with the right lawyer — Why it matters to your loved ones

When someone you love dies, grief alone can feel overwhelming. But, for many families, grief is only the beginning. Besides mourning, they are suddenly thrust into a legal and financial maze filled with court papers, deadlines, frozen accounts and unanswered questions. This painful reality plays out every day for families who are left to navigate the system without guidance. Working with the right lawyer before something happens is not really about you; it’s about protecting the people you love when they are at their most vulnerable.

Consider what happens when there is no clear plan or trusted legal advisor in place.

Molly believed her situation was simple. She wrote down her wishes herself, several times. After her death, her family discovered seven different handwritten “wills.” What followed was chaos. Frank’s story shows how the law, not love, decides when there is no plan. Frank built a business with two nephews who were like sons to him. They were the only family members at his funeral. But because Frank died without a will, the law required his estate to be divided equally among all 21 nieces and nephews, including relatives he hadn’t seen in decades. The two nephews who helped build the business received the same share as strangers.

These stories reveal a hard truth: Without the right lawyer, families are often left confused, unprotected and forced into court. Probate and conservatorship proceedings require navigating complex forms, strict deadlines and formal hearings, all while grieving. Assets are frequently frozen for months or even years, leaving loved ones unable to pay mortgages, access bank accounts or move forward with their lives.

The costs can be staggering. Court fees, statutory attorney fees and administrative expenses quickly add up. Even modest estates can lose tens of thousands of dollars, far more than the cost of proper planning. And because probate files are public, scammers and predators often target grieving families with fake claims and schemes.

Perhaps most painful of all, stress and grief magnify small disagreements into full-blown family battles. Relationships are damaged, sometimes permanently.

The good news is this suffering is often preventable. The right lawyer does more than draft documents. They act as a trusted advisor who understands your family, anticipates problems and provides a clear roadmap for the people you love. Planning ahead is one of the most meaningful gifts you can leave behind, peace, clarity, and protection when it matters most.
