Ask The Realtor – New rules in California real estate: What homebuyers need to know

As of Aug. 17, 2024, homebuyers in California, along with the rest of the nation, will experience a significant shift in how they purchase homes using a Realtor.

A new requirement mandates that before any Realtor shows a prospective buyer a home, there must be a signed buyer representation agreement between the buyer and the Realtor. This agreement not only lays out the responsibilities and duties of both parties but also addresses how the Realtor will be compensated for their services.

The primary purpose of this change is to provide clarity and protection for both buyers and Realtors. This formalized agreement ensures that all parties are on the same page from the start, reducing potential misunderstandings and disputes. According to Jessica Lautz, vice president of Demographics and Behavioral Insights at the National Association of Realtors (NAR), “This agreement solidifies the professional relationship between the buyer and their Realtor, ensuring that buyers have a clear understanding of the services being provided and the costs involved.”

Under the new rule, the buyer and their Realtor will agree on a compensation structure, which is typically a percentage of the purchase price or a flat fee. Buyers may choose to pay the representation fee directly or negotiate it into the offer, requesting the seller to cover part or all of the fee. It’s important to note that all compensation is negotiable, and each Realtor sets their own representation fees.

The buyer representation agreement is a step forward in aligning with the industry’s shift toward greater transparency. “Buyers will benefit from having a clear understanding of the services their Realtor is providing and the associated costs. This shift toward transparency is crucial for building trust in the home buying process,” says Lawrence Yun, chief economist at the National Association of Realtors.

As the California real estate market is one of the most competitive in the nation, this new requirement emphasizes the importance of buyers having dedicated representation. The agreement ensures that the Realtor is fully committed to the buyer’s interests, helping them navigate the complexities of the market, from property search to negotiating the best possible deal.

Buyers should be aware that, while the representation agreement is now required, each agreement can be customized to suit the needs and preferences of the buyer and the Realtor, making it essential to discuss all terms in detail before signing. This flexibility allows buyers to find the best fit for their specific needs, whether they are looking for full-service representation or a more a la carte approach.

The introduction of the mandatory buyer representation agreement marks a new era in real estate transactions. Buyers and Realtors alike will benefit from the clarity and professionalism this change brings, ensuring a smoother and more transparent home buying process.
