Estate Planning: Trust administration vs. probate in California—Understanding the difference

When a loved one passes away, families are often faced with the task of settling the decedent’s affairs and transferring assets to beneficiaries. In California, this process generally occurs through either trust administration or probate. While both serve the purpose of transferring assets after death, they differ significantly in cost, timing, privacy and complexity.

What is probate?

Probate is the court-supervised process of administering a deceased person’s estate when assets are held in the individual’s name alone and do not pass automatically to a beneficiary. During probate, the court appoints a personal representative (executor or administrator) to gather assets, pay debts and taxes and distribute the remaining property to heirs.

California probate can be lengthy and expensive. Depending on the size and complexity of the estate, the process often takes nine months to two years or longer. Additionally, California law provides for statutory attorney and executor fees based on the gross value of the estate, which can result in substantial costs.

Another important consideration is that probate is a public process. Court filings, asset inventories and distributions become part of the public record.

What is trust administration?

Trust administration is the process of managing and distributing assets held in a revocable living trust after the trust creator (settlor) passes away. Unlike probate, trust administration is generally handled privately by the successor trustee without ongoing court supervision.

The trustee’s responsibilities include gathering trust assets, notifying beneficiaries and creditors, paying debts and taxes and distributing assets according to the trust’s terms. While there are legal requirements that must be followed, the process is typically more streamlined and efficient than probate.

Advantages of trust administration in California

  1. Avoids probate. One of the primary benefits of a properly funded living trust is avoiding probate altogether. This can save beneficiaries significant time, stress, and expense.
  2. Faster distribution of assets. Because court approval is generally not required, trust administration often allows beneficiaries to receive their inheritance much sooner than they would through probate.
  3. Greater privacy. Trust administration is not a public court proceeding. The trust document, asset information and beneficiary distributions typically remain private, protecting the family’s financial affairs from public view.
  4. Lower costs. Although legal and administrative expenses may still arise, trust administration is often substantially less expensive than probate because there are no statutory probate fees and limited court involvement.
  5. Flexibility and continuity. A successor trustee can step in immediately upon the settlor’s incapacity or death, allowing for seamless management of assets without court intervention. This can be especially valuable when ongoing business interests, rental properties or investment accounts require immediate attention.

The importance of proper planning

Simply creating a trust is not enough. Assets must be properly transferred into the trust during the settlor’s lifetime, a process commonly referred to as “funding” the trust. Assets left outside the trust may still require probate.
