Legal preparations for worry-free holidays

Dec 20, 2023 | Business

Traveling for holidays is a time to unwind, create cherished memories with loved ones and escape from daily routines. However, before you embark on your holiday adventure, it’s crucial to ensure your legal affairs are in order, guaranteeing peace of mind and enabling you to savor your travels with absolute relaxation.

Establish powers of attorney: Before embarking on your holiday journey, whether it’s a local weekend getaway or an exotic international trip, it’s essential to have powers of attorney in place for both health care and financial matters.

Health care directive: This document designates a trusted individual to make medical decisions on your behalf in case of incapacitation during your holiday travels. Accidents can occur unexpectedly, and this document ensures your health-related wishes will be honored.

Financial power of attorney: A financial power of attorney empowers a trusted person to manage your financial affairs. By having this document, you grant someone the authority to handle your investments, pay bills or manage financial responsibilities while you’re traveling. It can also serve as a safeguard in case you become incapacitated or uncontactable.

By preparing these documents in advance, you safeguard your health and financial well-being while ensuring your wishes are upheld, even when you’re away from home.

Nominate permanent legal guardians for your children: As a parent, selecting a permanent guardian for your children is one of the most significant decisions you can make. Designating a permanent legal guardian ensures your children will be cared for by someone you trust if unforeseen events occur during your holiday travel. While it’s a difficult topic to address, making this choice ensures that your children will be looked after by someone who knows them and loves them, rather than leaving the decision in the hands of a court.

Designate short-term guardians for your children: In addition to nominating a permanent guardian, designating short-term legal guardians for your children is equally crucial to ensure your children are cared for in the short term while you’re traveling. These individuals will step in if the permanent guardian is far away or in cases of immediate emergency.  If your child will be with specific adults during your trip, be sure to name them as short-term guardians and grant them medical power of attorney if needed. Discuss these arrangements with the individuals you’ve selected, to ensure that they are aware of their roles and responsibilities in case of an emergency.

Inform your trusted contacts about your plans: Lastly, it’s essential to inform your trusted contacts about your holiday travel plans and the preparations you’ve made, such as your travel itinerary, the legal documents in place and how to access them if necessary. By keeping everyone informed, you ensure your wishes are known, and your loved ones can take prompt and effective action in the event of an emergency.
